Agreement to Terms
By downloading, installing, or using the GlowUp mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
Description of Service
GlowUp is a skincare tracking and recommendation application that:
- Analyzes facial photos using AI technology to assess skin conditions
- Provides personalized skincare routine recommendations
- Tracks your skincare progress over time
- Offers streak tracking and routine reminders
Eligibility
To use GlowUp, you must:
- Be at least 16 years of age
- Have a valid Apple ID for Sign in with Apple
- Have the legal capacity to enter into these Terms
Account Registration
You must create an account using Sign in with Apple to access the App's features. You are responsible for:
- Maintaining the security of your Apple ID credentials
- All activities that occur under your account
- Providing accurate information during onboarding
Subscriptions and Payments
Premium Features
GlowUp offers premium features through subscription plans. Subscriptions are processed through Apple's App Store.
Billing
- Payment will be charged to your Apple ID account upon confirmation of purchase
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel subscriptions in your App Store account settings
Refunds
Refunds are handled by Apple according to their refund policies. To request a refund, contact Apple Support or visit reportaproblem.apple.com.
Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Upload photos that are not of your own face
- Upload inappropriate, offensive, or non-facial images
- Attempt to reverse engineer, decompile, or hack the App
- Use the App to collect data about other users
- Circumvent any access restrictions or security measures
- Share your account credentials with others
- Use the App in any way that could damage or impair the service
Intellectual Property
The App, including its content, features, and functionality, is owned by GlowUp and is protected by copyright, trademark, and other intellectual property laws. You may not:
- Copy, modify, or distribute the App's content
- Use our trademarks or branding without permission
- Create derivative works based on the App
User Content
You retain ownership of photos and content you upload to the App. By uploading content, you grant us a limited license to:
- Store and process your photos for AI analysis
- Display your content back to you within the App
- Create anonymized, aggregated insights to improve our service
We will never share your identifiable photos or personal content with third parties without your explicit consent.
AI Analysis Disclaimer
Our AI-powered skin analysis:
- Provides estimates and suggestions, not definitive assessments
- May not detect all skin conditions or concerns
- Should not be relied upon for medical decisions
- Is continuously improving but may contain errors
Limitation of Liability
To the maximum extent permitted by law:
- GlowUp is provided "as is" without warranties of any kind
- We do not guarantee specific results from using the App
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid for subscriptions in the past 12 months
Indemnification
You agree to indemnify and hold harmless GlowUp and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.
Termination
We may suspend or terminate your access to the App if you:
- Violate these Terms
- Engage in fraudulent or illegal activities
- Abuse the service or other users
You may delete your account at any time through the App settings. Upon termination, your data will be deleted according to our Privacy Policy.
Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
